Members

The Lake County Board of Adjustment consists of the five (5) members of the Lake County Board of County Commissioners. The term of each member of the Board of Adjustment coincides with the respective County Commissioner terms. County zoning officials may be appointed as ex-officio members of the Planning Commission.

Meetings

Meetings are held at the call of the chairperson and at such other times as the Board of Adjustment may determine. Typically, the Board of Adjustment meetings are held in the Commission Room on regular County Commission meeting days, which take place on the 1st and 3rd Tuesday of each month. All meetings of the Board of Adjustment are open to the public and conducted in accordance with the rules established by the Board of Adjustment.

Duties

  • Administrative Review: To hear and decide where it is alleged by the appellant that there is an error in any order, requirement, permit decision, or determination made by the county zoning official or other administrative officers in the carrying out or enforcement of any provision of the Zoning Ordinance, and for interpretation of the Zoning Map.

  • Conditional Uses: To hear and decide applications for conditional uses that are specified in the Zoning Ordinance and for decisions on any special questions upon which the Board of Adjustment is specifically authorized to pass.

  • Variance: To hear and decide applications for variance from the terms of the Zoning Ordinance because of unnecessary hardship and to authorize upon appeal in specific cases such variance from the terms of the Zoning Ordinance as which will not be contrary to the public interest, where, owing to special conditions, a literal enforcement of the provisions of the Zoning Ordinance would result in unnecessary hardship and so that the spirit of the ordinance is observed and substantial justice done.

  • Any other duties as outlined in the Zoning Ordinance.
